Tax

Hawaii: more than 200 days (presumed resident)

Up to 200 days in Hawaii each calendar year

About This Rule

Counts your days in Hawaii each calendar year, the tax year for most people. If you are in Hawaii more than 200 days of the tax year in the aggregate, you are presumed to be a resident. You can overcome the presumption by showing you keep a permanent place of abode outside Hawaii and are there for a temporary or transitory purpose, and you can also be a resident with fewer days. This tracks the day count only and doesn't decide your residency.

Ready-made rules count your days against the limits the law names. They don't decide your visa or residency status, and many laws add conditions a day count can't see.
