Tax

North Carolina: more than 183 days (presumed resident)

Up to 183 days in North Carolina each calendar year

About This Rule

Counts your days in North Carolina each calendar year, the tax year for most people. In the absence of convincing proof to the contrary, you are presumed to be a resident if you are present in North Carolina for more than 183 days during the tax year. Being away for more than 183 days raises no presumption that you are not a resident, and domicile or living in the state for other than a temporary purpose also makes you one. This tracks the day count only and doesn't decide your residency.

Ready-made rules count your days against the limits the law names. They don't decide your visa or residency status, and many laws add conditions a day count can't see.
