Tax

Idaho: more than 270 days (statutory resident)

Up to 270 days in Idaho each calendar year

About This Rule

Counts your days in Idaho each calendar year, the tax year for most people. You are a resident if you maintain a place of abode in Idaho for the entire tax year and spend in the aggregate more than 270 days of the year there; presence for any part of a calendar day counts, unless you can show that day's presence was for a temporary or transitory purpose. If Idaho is your domicile for the entire year, you are a resident unless you meet a narrow exception for long absences (at least 445 days away in the first 15 months, then no more than 60 days a calendar year in Idaho), and neither test applies to nonresident aliens as defined for US federal tax. This tracks the day count only and doesn't decide your residency.

Also Requires

  • A place of abode in Idaho for the entire year

Ready-made rules count your days against the limits the law names. They don't decide your visa or residency status, and many laws add conditions a day count can't see.
