Tax

New Jersey: more than 183 days (statutory resident)

Up to 183 days in New Jersey each calendar year

About This Rule

Counts your days in New Jersey each calendar year, the tax year for most people. If New Jersey is not your domicile, you are a nonresident when you spend 183 days or less in the state, or more than 183 days without maintaining a permanent home there; more than 183 days with a permanent home makes you a resident. If New Jersey is your domicile, you are a resident unless you meet a separate 30-day test. This tracks the day count only and doesn't decide your residency.

Also Requires

  • A permanent home in New Jersey

Ready-made rules count your days against the limits the law names. They don't decide your visa or residency status, and many laws add conditions a day count can't see.
